A felony for drunk driving

A new drunk driving law has come into force in Ukraine. The amount of the fine, criminal liability for violation of the rules, what to expect for drivers has been named.

Recently in Ukraine it is not uncommon for a driver to drive a vehicle while intoxicated. Starting from July 1, 2020, a law came into force in Ukraine, which provides for criminal liability for driving a car while under the influence of alcohol, drugs, or under the influence of other intoxicating substances.

Thus, Law No. 2617-VII provides for tougher punishment of a driver for driving while intoxicated with drugs or alcohol. Previously, the norm came into effect on January 1, 2020, but then the parliament postponed it until July 1, 2020.

In addition to alcohol and drug intoxication, the law also mentions intoxication or exposure to drugs that reduce reaction and attention. They were also classified as drugs that should not be taken before driving a car. In the event of a violation, information about a criminal offense is entered into the database of the National Police, and in the future it will be displayed in a certificate of the presence or absence of a criminal record.

If you believe the edits of the new law, now criminal liability also occurs in the case of a driver refusing to pass a test for alcohol or drug intoxication, the use of drugs that dull the action. Also, a criminal offense occurs in the case of drinking alcoholic beverages after the driver is stopped by the police or in the event of an accident, in the interval before a medical examination. On the one hand, this excludes cases that the driver is trying to evade responsibility, and on the other hand, by violating this paragraph, the driver automatically becomes a violator.

Following the tightening of the rules and regulations of the law, fines have increased. So for the first receipt of a fine, the driver will need to pay from 17,000 to 34,000 hryvnia ($ 630- $ 1264), plus the driver will be deprived of the right to drive a vehicle for up to three years. In case of repeated violation of the law, the fine increases to UAH 51,000 ($ 1,895), plus the deprivation of the right to drive a vehicle for a period of 2 to 3 years.

Most likely, one thought about deprivation of rights or an increase in the amount of a fine will make, if not all, then most of the drivers, think about whether it is worth driving under the influence of alcohol or drugs. It is possible that in the future the rules may be toughened, and the fines may be increased even further.
